DEADLINE TO JOIN LAWSUIT:

We anticipate initiating litigation on behalf of Covid EIDL applicants who were approved for either a loan or an increase of a loan but did not receive disbursement of funds.

WHO IS ELIGIBLE TO JOIN AS A NAMED PLAINTIFF?

You are eligible to join as a named plaintiff if one of the following two scenarios applies:

1. The SBA approved your loan but did not disburse the funds;

or

2. The SBA approved an increase of your loan but did not disburse additional funds.

Please note: The location of your business, or whether your business is still operational, does not affect eligibility.

WHAT IS THE PURPOSE OF THIS LITIGATION?

This litigation will seek to secure disbursement of funds for the named plaintiffs and compensatory damages.

HOW DO I JOIN AS A NAMED PLAINTIFF?

Submit the Eligibility Questionnaire. We will let you know by email if you are eligible and, if so, send further instructions on completing the required steps: 1) uploading documents; 2) signing a contract of representation; and 3) paying the legal fees.

I APPLIED FOR A LOAN/INCREASE BUT DID NOT RECEIVE A NOTICE OF APPROVAL. AM I ELIGIBLE?

No. If you did not receive a written notice of approval you are not eligible to join this litigation. Please review the eligibility requirements of our other EIDL lawsuits as one may address your specific circumstances.

WHAT ARE THE LEGAL FEES?

There will be a fee of $1,300 to join the lawsuit as a named plaintiff.

 

A second payment will be due if and only if you receive a favorable outcome: if the SBA funds your loan or loan increase a fee of $700 will be due; if you receive damages from the court or from a settlement the Firm will collect 20%.

The Firm will refund the initial fee in full if the lawsuit is not filed. Otherwise, the initial fee is considered earned on payment and is not refundable.

You will not be responsible for any fees, charges, costs, or expenses related to this litigation other than the fees identified above.

CAN I PARTICIPATE IN MORE THAN ONE LOLRG EIDL LAWSUIT?

No. While you may be eligible to join more than one lawsuit you can be a named plaintiff in only one. Upon review of your questionnaire and supporting documents we will recommend the best lawsuit for you.

HOW WILL NAMED PLAINTIFFS BE KEPT APPRISED OF DEVELOPMENTS IN THE CASE?

Named plaintiffs will have their own members-only portal on this website where we will provide regular updates, share legal documents, and hold scheduled chats. We will also hold zoom calls where named plaintiffs will receive updates and be able to ask questions of the lead counsel.

Please note: due to the nature of aggregate litigation the Firm will not be responding to individual inquiries regarding this litigation or the underlying loans outside of the members-only portal and scheduled group settings.

DO YOU GUARANTEE SUCCESS?

No. There is no such thing as a guaranteed outcome in any litigation.
